TERMS AND CONDITIONS FOR THE PURCHASE OF EVMI EARNED VALUE MANAGEMENT INSTITUTE ASSETS VIA THE EVMI
MARKETPLACE AND SHOP
This Agreement details the terms and conditions of use concerning the purchase of a “EVMI
Asset” (Articles/ Papers, Tables/Figures and reports) via the EVMI Marketplace. This Agreement
is governed by the laws of the Commonwealth of Pennsylvania, USA, excluding choice of law
doctrines. We recommend that you print this Agreement and relevant parts of our website for
your records.
I. EVMI Periodicals, Conference Papers, EVMI Salary Survey Reports
A. Grant of License. EVMI grants to User the limited license to view, download, and print
the Article/Paper/Report for their own noncommercial business or personal use. All other
uses are beyond the scope of this license.
Please contact EVMI if other uses are desired.
This license is freely revocable. EVMI may change, suspend, or terminate access to the
articles/papers/reports for any reason, at any time, and without notice or liability.
Permission to reproduce articles from PM Network® and Project Management Journal®
may also be obtained through the Copyright Clearance Center at www.copyright.com.
B. Copyright and Restriction on Use. All articles, papers and reports are protected by
the United States copyright laws and international treaty provisions. The User may not
alter the Article/Paper/Report in any way. The User may not rent, lease, sell, or otherwise
transfer all or any portion of the Article/Paper/Report. User is prohibited from publishing
the Article/Paper/Report in print or reproducing/distributing it in any way including
posting to an Intranet. User is prohibited from posting the Article/Paper/Report on the
World Wide Web. User shall be responsible for all uses of the Article/Paper/Report
arising out of your purchase, whether or not such use was actually or expressly
authorized. User agrees to report any copyright violations concerning the
Article/Paper/Report as soon as they become known to the User.
C. Format and Security. Articles/Papers delivered electronically to a customer’s digital
lockbox are presented as an Adobe® PDF file. User is prohibited from using any methods,
programs, or devices to disable or circumvent security measures used by copyright
owners to protect their works from unauthorized alterations. Articles/Papers/Reports for
which EVMI does not have electronic distribution rights will be printed and mailed to the
customer. The same copyright protections apply to printed Articles/Papers/Reports as for
electronically delivered Articles/Papers/Reports.
II. Tables and Figures (EVMBOK® Guide)
A. Grant of License: EVMI grants to User the limited license to view or download the
Table(s)/Figure(s) purchased by User from the EVMI web site and to reproduce, present,
and distribute such Table(s)/Figure(s) for personal noncommercial use or for purposes
related to the delivery of non earned value management training courses only (the “Permitted
Uses”). All other uses are beyond the scope of this license. Please complete our online
permissions request form if other uses are desired. This license is freely revocable. EVMI
may change, suspend, or terminate access to the Table(s)/Figure(s) for any reason, at any
time, and without notice or liability.
B. Copyright and Restriction on Use: The Table(s)/Figure(s) is/are owned by EVMI and
is/are protected by the United States copyright laws and international treaty provisions.
Therefore, the User must treat the Table(s)/Figure(s) like any other copyrighted material
and use the Table(s)/Figure(s) only in accordance with the terms of this license. The User
may not alter the Table(s)/Figure(s) in any way. The User may not rent, lease, sell, or
otherwise transfer all or any portion of the Table(s)/Figure(s). User is prohibited from
publishing the Table(s)/Figure(s) in print for the purposes other than the Permitted Uses.
User is prohibited from posting the Table(s)/Figure(s) on the World Wide Web. User
shall be responsible for all uses of the Table(s)/Figure(s), whether or not such use was
actually or expressly authorized. User agrees to report any copyright violations
concerning the Table(s)/Figure(s) as soon as they become known to the User.
C. Format and Security: The Table(s)/Figure(s) is/are presented as an image file in a
.jpeg or .tif format. User is prohibited from using any methods, programs, or devices to
disable or circumvent security measures used by copyright owners to protect their works
from unauthorized alterations.
III. Miscellaneous
A. Cancellations and Returns: Once purchased, EVMI Asset(s) delivered electronically
shall remain in the User’s digital lockbox for a period of 21 days. Once these Assets are
successfully downloaded within the 21-day period, they will no longer be available for
download. User may cancel their order/purchase of a selected EVMI Asset(s) prior to
downloading such Asset(s), so long as cancellation occurs within the 21-day availability
period, otherwise User shall be charged in full for the EVMI Asset(s). EVMI Asset(s),
whether delivered electronically or in print, may not be returned for refund unless User
determines that their use of such Asset(s) is not a Permitted Use, as described in Section
I.A. and II.A. above.
B. No Warranties: The EVMI Asset(s) is/are provided as is, without warranty of any kind.
EVMI specifically disclaims all warranties, either express or implied, including but not
limited to any implied warranties of merchantability and fitness for a particular purpose,
with regard to the EVMI Asset(s).
C. No Liability: In no event shall EVMI be liable for any damages whatsoever (including,
without limitation, damages for loss of business profits or any other pecuniary loss)
arising out of the use of the EVMI Asset(s), even if EVMI has been advised of the possibility
of such damages. Because some states and countries do not allow the exclusion or
limitation of liability for consequential or incidental damages, the above limitation may
not apply to the User.
D. Acceptance of License: By clicking on the acceptance button during checkout,
and/or by downloading and/or using the EVMI Asset(s), User indicates acceptance of the
terms set forth in this license. If User is accepting this license on behalf of a corporate
licensee, User represents that User is authorized to do so. If User is not authorized, nor
deemed so by law, User assumes sole personal liability for the obligations set forth
above.
